PLEASE READ THESE TERMS CAREFULLY BEFORE AUTHORIZING ANY SERVICE
These Terms and Conditions of Service (“Terms”) constitute a legally binding agreement between you (“Customer”) and Tonys Garage Inc., a Florida profit corporation (“Company,” “we,” “us,” or “our”). By scheduling, authorizing, or accepting any service — whether via phone, online booking, or in person — you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

2. SCOPE OF SERVICES
Tonys Garage Inc. provides professional automotive repair, maintenance, diagnostics, and performance services for passenger and commercial vehicles at our facility located at 5541 US Highway 19, New Port Richey, Florida. Our core services include:
- Auto repair and general mechanical service
- Transmission service and repair
- Air conditioning and HVAC service
- Suspension and steering repair
- Vehicle diagnostics
- Wheel alignment
- Tire service
- Performance upgrades — including ECU/TCU tuning, exhaust, intake, suspension, and brake upgrades
Tonys Garage Inc. specializes in European and luxury vehicle brands including BMW, Mercedes-Benz, Porsche, Audi, Volkswagen, Land Rover, McLaren, Maserati, and Ferrari.
2.1 Services Not Offered
Tonys Garage Inc. does not provide bodywork, paint, detailing, car sales, or hybrid/EV-specific services. We reserve the right to decline any service at our sole discretion, including situations where vehicle condition, parts unavailability, or safety concerns make completion impractical.
3. SERVICE AUTHORIZATION & BOOKING
3.1 How to Book
Appointments are booked by calling us directly at (727) 697-2697 during business hours (Monday–Friday, 8:00 AM–5:00 PM). An online appointment request form is also available at https://www.tonysgarageinc.com/. Submission of an online request is a request only and is not a confirmed appointment until acknowledged by our team.
After hours, calls are directed to voicemail and emails receive an automatic reply. All after-hours communications will be responded to the next business day.
3.2 Written Authorization
Before any repair or maintenance work commences, we will obtain your authorization by phone or in person. For major repairs, a written work order may be required bearing your signature. By authorizing work, you confirm that you are the legal owner of the vehicle or are expressly authorized by the legal owner to approve repairs.
3.3 Estimate Changes — You Are Always Called First
If during the course of a repair we discover additional problems or if the cost is expected to increase beyond the original estimate, we will contact you by phone before proceeding with any additional work. You have the right to:
- Authorize the additional work and the revised cost
- Decline the additional work and authorize only the originally agreed scope
- Request that the vehicle be reassembled without completing the repair — reassembly fees may apply
Florida Statute § 559.905 (Florida Motor Vehicle Repair Act) requires your consent before any additional cost is incurred. We comply fully with this requirement.
3.4 Replaced Parts
You may request the return of any parts replaced during your repair. Exceptions apply to parts subject to warranty core-charge agreements or parts required to be returned to the vendor.
4. DIAGNOSTIC FEES
A diagnostic or inspection fee is charged for all vehicle assessments. This fee covers the time and expertise required to accurately diagnose your vehicle. The applicable diagnostic fee will be communicated to you before any diagnostic work begins.
If you approve and proceed with the repair based on our diagnosis, the diagnostic fee is waived and will not be added to your final invoice. If you decline the repair after diagnosis, the diagnostic fee remains payable in full before vehicle release.
5. PRICING & ESTIMATES
5.1 Nature of Estimates
All estimates provided by Tonys Garage Inc. — whether verbal or written — are good-faith approximations based on visible conditions at the time of assessment. Estimates are not guaranteed fixed-price quotes unless expressly confirmed in writing. Final charges may vary based on actual time, parts, and conditions encountered during the repair.
5.2 Labor Rates
Labor is charged at our standard rate as posted at our facility and communicated at the time of booking. Labor is billed based on actual time expended or industry-standard flat-rate book times, whichever is applicable to the repair.
5.3 Parts
All parts are sourced by Tonys Garage Inc. from reputable suppliers including OEM and approved aftermarket vendors. We do not accept customer-supplied parts — see Section 8. Parts pricing is subject to market availability at the time of order.
6. PAYMENT TERMS
6.1 Payment Due at Pickup
Full payment for all Services is due upon completion of the repair and prior to vehicle release. Your vehicle will not be released until payment has been received in full.
6.2 Accepted Payment Methods
We accept the following payment methods:
- Cash
- Credit and debit cards (Visa, Mastercard, American Express, Discover)
- Digital payments — Zelle and Apple Pay
- Financing — Klarna and Affirm (subject to approval by the respective financing provider)
Financing through Klarna or Affirm is subject to the terms, conditions, and credit approval of those third-party providers. Tonys Garage Inc. is not a party to your financing agreement and bears no responsibility for financing approvals, denials, or repayment terms.
6.3 Deposits for Major Repairs
For high-cost repairs, special-order parts, or at our discretion, a deposit may be required before work commences. The deposit amount will be communicated and agreed upon in advance. Deposits are non-refundable if the Customer cancels after parts have been ordered or work has begun.
6.4 Mechanic’s Lien — Florida Law
Pursuant to Florida Statute § 713.585, Tonys Garage Inc. reserves the right to assert a mechanic’s lien on any vehicle for which Services have been performed and full payment has not been received. A vehicle subject to a lien may be retained by Tonys Garage Inc. until all outstanding amounts are paid in full. If a vehicle remains unclaimed and unpaid for thirty-five (35) or more days, we may pursue lien enforcement proceedings as permitted by Florida law, which may include the lawful sale of the vehicle to recover amounts owed.
7. VEHICLE STORAGE POLICY
Upon notification that your vehicle is ready for pickup, you are expected to collect it within three (3) business days. If your vehicle is not collected within this period and no prior arrangement has been made with our team, the following daily storage fees will apply:
- Outdoor Storage: $75.00 per day
- Indoor Storage: $125.00 per day
Storage fees begin accruing on the fourth business day following our notification that your vehicle is ready. All outstanding storage fees must be paid in full before the vehicle will be released. Vehicles left uncollected for an extended period may be subject to the mechanic’s lien process described in Section 6.4.
8. CUSTOMER-SUPPLIED PARTS
Tonys Garage Inc. does not accept or install customer-supplied parts under any circumstances. All parts used in repairs must be sourced and supplied by Tonys Garage Inc. This policy exists to ensure quality, warranty coverage, and the safety of your vehicle.
Any request to install customer-supplied parts will be respectfully declined. Labor quotes are provided only for repairs using parts sourced by our shop.
9. WARRANTY — 24 MONTHS / 24,000 MILES
Tonys Garage Inc. stands behind every qualifying repair we perform. We offer the following warranty on all eligible Services:

9.1 Parts Warranty
All parts installed by Tonys Garage Inc. on qualifying repairs are warranted against part failure and manufacturer defects for twenty-four (24) months or 24,000 miles from the date of service completion, whichever occurs first.
9.2 Labor Warranty
All labor performed by Tonys Garage Inc. on qualifying repairs is warranted against workmanship defects directly related to the repair performed for twenty-four (24) months or 24,000 miles from the date of service completion, whichever occurs first.
9.3 Warranty Exclusions
This warranty does not cover:
- All fluids — including but not limited to engine oil, transmission fluid, coolant, brake fluid, and power steering fluid
- Freon and refrigerant
- Normal wear-and-tear items — including brake pads, rotors, belts, filters, and wiper blades
- Damage caused by accident, misuse, off-road use, or neglect following the repair
- Damage resulting from failure to follow recommended post-repair maintenance
- Pre-existing conditions unrelated to the specific repair performed
- Vehicles subsequently repaired, modified, or tampered with by another shop or individual after our repair
- Customer-supplied parts — not applicable as we do not accept them
9.4 Making a Warranty Claim
If you experience an issue that you believe is covered by this warranty, contact us promptly at service@tonysgarageinc.com or call (727) 697-2697. Do not take the vehicle to another shop before contacting us, as unauthorized third-party repairs will void this warranty. We will inspect the vehicle and, if the issue falls within warranty coverage, perform the necessary repair at no charge.
9.5 Warranty Transferability
This warranty applies to the original Customer vehicle only. It is not transferable to subsequent owners.
This warranty gives you specific legal rights. You may also have additional rights under Florida Statute Chapter 501 (Florida Consumer Protection Law). Nothing in this warranty limits any rights available to you under applicable law.
10. VEHICLE DROP-OFF & CARE
10.1 Customer Responsibilities at Drop-Off
- Remove all personal belongings and valuables from the vehicle before drop-off. Tonys Garage Inc. is not responsible for personal items left in a vehicle during the service period.
- Disclose all known defects, warning lights, prior repairs, and modifications relevant to the requested service.
- Provide accurate contact information so we may reach you promptly for authorizations and updates.
10.2 Care of Your Vehicle
Tonys Garage Inc. will exercise reasonable professional care with your vehicle while it is in our possession. We maintain garage keeper’s liability insurance as required under Florida law. We are not responsible for pre-existing damage not documented at drop-off, acts of God or weather events, or theft and vandalism occurring despite reasonable security precautions.
10.3 Test Drives
For quality assurance purposes, Tonys Garage Inc. may conduct a test drive of your vehicle on public roads following certain repairs — including but not limited to brake work, suspension repairs, transmission service, and engine repairs. By authorizing Services, you consent to test drives conducted solely by authorized Tonys Garage Inc. employees for the purpose of verifying repair quality.
11. PERFORMANCE UPGRADES & TUNING
Tonys Garage Inc. offers performance upgrades including ECU and TCU tuning, exhaust upgrades, intake systems, suspension modifications, and brake upgrades for both street and track use. By authorizing performance work, the Customer acknowledges and agrees to the following:
- Performance modifications may alter the vehicle’s handling, power output, and behavior. The Customer accepts full responsibility for the safe and lawful operation of the vehicle following any performance modification.
- Performance modifications may void or affect the vehicle’s manufacturer warranty. The Customer is responsible for understanding this risk before authorizing work.
- Tonys Garage Inc. is not liable for increased wear, mechanical failure, or damage arising from the use of a modified vehicle beyond its original design parameters.
- Track use following performance modifications is undertaken entirely at the Customer’s own risk.
- Aftermarket parts installed by Tonys Garage Inc. carry manufacturer warranties where applicable. Our labor warranty applies as set out in Section 9.
12. LIMITATION OF LIABILITY
12.1 Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FLORIDA LAW, TONYS GARAGE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SERVICES PROVIDED, INCLUDING BUT NOT LIMITED TO RENTAL VEHICLE COSTS, LOSS OF USE, LOST WAGES, LOST PROFITS, OR LOSS OF BUSINESS INCOME.
12.2 Liability Cap
Our total aggregate liability to any Customer for any claim arising from or related to Services performed shall not exceed the total amount paid by that Customer for the specific Service giving rise to the claim.
12.3 Indemnification
The Customer agrees to indemnify, defend, and hold harmless Tonys Garage Inc., its officers, employees, and agents from any claims, liabilities, damages, or expenses — including reasonable attorneys’ fees — arising from the Customer’s breach of these Terms, misrepresentation of vehicle ownership or authorization, or use of the vehicle in a manner inconsistent with our post-repair recommendations.
13. FLORIDA MOTOR VEHICLE REPAIR ACT
Tonys Garage Inc. operates in full compliance with the Florida Motor Vehicle Repair Act, Florida Statutes §§ 559.901–559.9221. Your rights under this Act include:
- The right to a written estimate before work begins, upon request
- The right to be notified of and consent to any cost increase before additional work proceeds
- The right to request the return of replaced parts, subject to applicable exceptions
- The right to a written invoice itemizing all parts and labor upon completion of Services
- The right to file a complaint with the Florida Department of Agriculture and Consumer Services

14. DISPUTE RESOLUTION
14.1 Good-Faith Resolution First
In the event of any dispute or complaint arising from our Services, both parties agree to first attempt resolution in good faith. Contact us directly at service@tonysgarageinc.com or call (727) 697-2697. We are committed to resolving all customer concerns promptly and professionally.
14.2 Mediation
If a dispute cannot be resolved informally within thirty (30) days, either party may request non-binding mediation before a mutually agreed mediator in Pasco County, Florida. Costs of mediation shall be shared equally unless otherwise agreed in writing.
14.3 Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any legal proceedings shall be brought exclusively in the state or federal courts of Pasco County, Florida. Both parties consent to personal jurisdiction in those courts.
14.4 Waiver of Jury Trial
TO THE FULLEST EXTENT PERMITTED BY LAW, BOTH PARTIES WAIVE THEIR RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES PROVIDED.
15. ONLINE BOOKING & WEBSITE TERMS
Submission of an online appointment request at https://www.tonysgarageinc.com/ constitutes a request for service only. It authorizes us to review your request and contact you to confirm availability. It does not constitute authorization to perform repairs until you explicitly approve an estimate.
- You are responsible for ensuring all information submitted via our online booking form is accurate and complete.
- We reserve the right to decline any booking at our discretion without liability.
- Appointment confirmations are sent by email or phone. Monitor your contact information for our response.
16. PRIVACY
The collection and use of your personal information — including your name, contact details, vehicle information, and VIN — is governed by our Privacy Policy, available at https://www.tonysgarageinc.com/ and incorporated into these Terms by reference. By using our Services, you consent to the data practices described in our Privacy Policy.
17. MODIFICATIONS TO THESE TERMS
Tonys Garage Inc. reserves the right to update these Terms at any time. Changes take effect upon posting the revised Terms on our website with an updated effective date. For Services already authorized before a change, the Terms in effect at the time of authorization apply.
18. SEVERABILITY & ENTIRE AGREEMENT
If any provision of these Terms is found invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force. These Terms, together with any written work order and our Privacy Policy, constitute the entire agreement between the parties and supersede all prior understandings, whether oral or written.

CUSTOMER ACKNOWLEDGMENT
By authorizing Services from Tonys Garage Inc. — whether by phone, online booking, or in person — you confirm that you have read, understood, and agree to be bound by these Terms and Conditions of Service in their entirety. If you are authorizing Services on behalf of another person or business entity, you represent that you have full authority to bind that person or entity to these Terms.
These Terms were prepared in accordance with the Florida Motor Vehicle Repair Act (Fla. Stat. §§ 559.901–559.9221), the Florida Mechanic’s Lien Statute (Fla. Stat. § 713.585), and the Florida Consumer Protection Law (Fla. Stat. Chapter 501).
